MCCRACKEN COUNTY, KY (KFVS) – The McCracken County Sheriff’s Department arrested a Paducah man after a two car crash on Brookport Bridge on Tuesday, Nov. 11.James R. Lambert, 49, was charged with operating a motor vehicle under the influence of alcohol/drugs third offense, operating on a suspended/revoked operator’s license, assault fourth degree (two counts based on the injuries sustained to others by his driving impaired), criminal mischief first degree, tampering with physical evidence, possession of marijuana and possession of drug paraphernalia.Deputies say they were notified at 4:44 p.m. about a head on crash. When they arrived, they say they helped emergency workers care for the injured because response was low due to slowed traffic and the tight confines of the bridge.

According to deputies, Lambert was driving a 1996 Dodge truck southbound on the bridge.

They say the investigation, along with witness statements, indicate that speed was a factor and that Lambert lost control of the truck and hit an oncoming car.

The northbound car was a 1994 Toyota driven by Martie L. Stewart, 61, of Brookport, Ill.

At one point during the investigation, deputies say they saw Lambert throw items from the Brookport Bridge.

They say a search below the bridge was conducted and drug paraphernalia and marijuana was found.

Deputies say it was also determined that Lambert was under the influence of marijuana at the time of the crash.

They say Stewart was taken by ambulance to a Paducah hospital for apparent non-life threatening injuries.

Lambert’s passenger, 42-year-old Katrina A. Warren, of Brookport, was taken by ambulance to a hospital for non-life threatening injuries.

Deputies say Lambert has a lengthy criminal  history involving driving while impaired, including a felony driving under the influence conviction in 2006 in McCracken County.

Alcohol is one of the leading contributors to Wrongful Death in the State of Kentucky along with Speeding and Driver Inattention.  The fact that Alcohol was a factor in this Car Accident means that there could be a Civil Suit to follow.  The Driver has been charged with DUI and Assault, so a Civil suit could likely follow.

Martie Stewart will no doubt have a Civil Case for her Injuries.  She can file Damages claims for Lost Earnings Capacity, Punative Damages, Reasonable Medical Bills, and Pain and Suffering.
