A Cadiz woman died on the evening of Monday, June 27 after being involved in an ATV accident in Trigg County.
Lisa Williams, a 29-year-old passenger on the ATV driven by Cadiz resident 23-year-old Benjamin Papajeski, was thrown from the ATV during the collision. Williams was treated at the Trigg County Hospital and was airlifted to Vanderbilt University Hospital, but died on Monday evening. She was not wearing a helmet.
Papajeski and Ronald J. Smith Jr., a 22-year-old resident of Cadiz, were driving the ATV's. Smith turned to drive into the Cadiz Fire Department parking lot, and Papajeski couldn't stop, colliding with Smith. Neither Smith nor Papajeski were seriously injured.
This accident shows how dangerous ATV's can be. While many people usually don't feel like ATV's are dangerous as motorcycles because ATV's have four wheels instead of two, ATV's still can cause serious injury or even death.
In the case of Lisa Williams, the state police will open a death investigation where they will determine the cause of her death, possibly leaving her estate with a wrongful death case.
In a Kentucky Wrongful Death case, the estate can possibly recover reasonable medical and funeral expenses and lost earnings capacity.
