Possible Wrongful Death Claim In Logan's Parking Lot Accident
A Marion, Illinois, man who backed over and killed a woman in the parking lot at Logan's restaurant in Paducah was sentenced to seven years in jail today.
Michael Dunaway had already pleaded guilty to manslaughter and DUI for backing over 63-year-old Anke Knopp in the Logan's parking lot in Paducah last October.
Knopp and her husband were driving home to Florida after a trip to Wisconsin and had stopped in Paducah for the night. Police say Dunaway's rear tire ran over Knopp twice.

Under Kentucky law, a wrongful death has occurred if someone causes the death of another due to negligence, recklessness, or lack of skill. Wrongful death claims are pursued through the civil court system, as opposed to the criminal justice system. It is possible for a person to be tried for a criminal charge of first or second degree murder or manslaughter, and also be tried under civil laws for financial damages caused by wrongful death.
It is obvious that had it not been for Mr. Dunaway's recklessness and negligence, Mrs. Knopp would still be alive and enjoying time with her family. Dunaway was intoxicated, which makes his negligence even more disgusting and intolerable. The Knopp family most likely has a very strong wrongful death claim against Dunaway. It is claims like these that allow Daryl T Dixon, a Kentucky Wrongful Death Attorney, to fight for the families and make sure they are duly compensated for the loss of cherrished loved one.
